SIDNEY — The case of a man charged in the robbery of a Sidney carryout has been bound over to Shelby County Common Pleas Court.

Scott W. Carson, 39, 11744 Fair Road, waived his right to a preliminary hearing Monday in Sidney Municipal Court and the case was ordered bound over. Bond was set at $100,000.

Carson and Jill Elliott, 30, 5435 Short Road, Houston, were arrested Saturday night on Interstate 75 by a Tipp City Police officer, with help from Troy Police and Miami County Sheriff’s officers. Police stopped their vehicle after it was identified as being at the scene of a robbery in Sidney. Officers later released the suspects to Sidney Police.

Elliott was charged with complicity to theft. Police said she was the driver in the incident. Elliott’s case has been set for a pretrial hearing Oct. 26 in Municipal Court.

Sidney Police Capt. Jerry Tangeman said Carson was charged for one count of aggravated robbery for allegedly robbing the Main Stop Drive Thru. After leaving the Main Stop, Carson went to the Marathon station on Fair Road and grabbed money from the cash register when the clerk opened the drawer during a purchase, Tangeman said. The clerk chased after Carson and got the license plate number and a description of the vehicle that the suspect got into. Carson was not the driver; it is believed Elliott was.

Tangeman said the information was broadcast to surrounding agencies, at which point the vehicle was located by Tipp City law enforcement. Both Carson and Elliott were found in the car. Carson also had a warrant for drug trafficking issued out of the Shelby Common Pleas Court. He was arrested on that charge and then later charged for the aggravated robbery at the Main Stop. Carson is going to be charged later with a misdemeanor theft for what occurred at the Marathon, Tangeman said. Elliott was immediately charged for complicity to theft for allegedly driving the getaway car at the Marathon station.
