Middletown man sentenced to prison

SIDNEY – A Middletown man will spend the next 2 ½ years in prison for crashing his vehicle into a patrol cruiser to escape apprehension along Interstate 75.

Other defendants were also handed incarceration orders by Judge James Stevenson recently in Shelby County Common Pleas Court.

Kenneth Heaton, 36, was sentenced to the custody of the Ohio Department of Rehabilitation and Correction on a charge of failure to comply with the order of a police officer, a third-degree felony. He will also have his driver’s license suspended for five years following his release.

According to online court records, Heaton was driving more than 85 miles per hour when a trooper with the Ohio State Highway Patrol attempted to make a traffic stop on July 26. Heaton used his vehicle to strike the cruiser while being pursued.

A Sidney man was sentenced to nine months in prison for striking a Sidney police officer on July 13.

Michael Dean Ceyler Sr., 55, incarcerated, will be jailed with the ODRC for nine months on a charge of attempted assault, a fifth-degree felony. He entered into a plea agreement after being found competent to stand trial.

Curtis J. Stueve, 25, 101 First St. Apt. C, Russia, was sentenced to 30 days in the county jail work release program for attempted assault, a fifth-degree felony. He was also ordered to successfully complete mental health counseling, complete drug, and alcohol counseling, fined $400 and assessed court costs.

On Aug. 31, Stueve was taken to the Wilson Health emergency room where he assaulted a nurse and security officer while be treated.

Durbin P. Lawson, 60, 3120 State Route 66, Houston, was given a 30-day suspended jail term on a charge of obstructing official business, a second-degree misdemeanor. The jail stay will be suspended if a $200 fine and court costs are paid within 30 days.

According to authorities, Lawson attempted to conceal the fact wanted felon Michael Cotterman was in his house when questioned by Shelby County Sheriff’s deputies.

A Sidney man faces mandatory prison time as part of a plea agreement for his involvement in a sex crime conviction.

Scott E. Hudgins, 54, 721 Linden Ave., pleaded guilty to a single charge of gross sexual imposition, a fourth-degree felony. He had been indicted for rape, a first-degree felony, for having sexual activity with a woman who was intoxicated and asleep on Sept. 3.

He faces a maximum sentence of 18 months in prison, a $5,000 fine, and five years of community control following his release. He is currently being held at the Shelby County Jail on a $7,500 bond.

Hudgins’ plea deal in the first case was contingent that he entered a guilty plea to trafficking in drugs charge, a fifth-degree felony, in a second case. He was arrested on June 28 in possession of cocaine.

He faces a maximum sentence of one year in prison and a $2,500 fine.

In other cases:

• Marqueeze C. Knight, 23, Xenia, was placed on five years of community control on a charge of possession of drugs, a fourth-degree felony. He was also ordered to complete drug and alcohol counseling, fined $200 and ordered to pay court costs.

• Izaac James Millhouse, 24, 820 Taft St., pleaded guilty to operating a motor vehicle under the influence, an unclassified third-degree misdemeanor. He was also ordered to forfeit his vehicle due to three OVI convictions within the last 10 years.

He faces a maximum of 2 to 12 years in prison with a mandatory 60 days in the county jail. He will be sentenced on April 24.

• Mark Wita, 40, 323 E. Main St., Port Jefferson, failed to appear in court for a pretrial hearing on a charge of possession of drugs and possession of criminal tools, both fifth-degree felonies. Judge Stevenson issued an arrest warrant.

• Richard C. Eaton, 56, 315 Washington St., was sentenced to five years of community control on a charge of obstructing justice, a fifth-degree felony. He was also fined $300 and assessed court costs. The court also ordered Sidney Police destroy a handgun confiscated from Eaton.

• A bench warrant was issued for Brett Taylor, 34, at large, when he failed to appear for two court appearances on March 1. He faced a bond revocation hearing on a conviction of aggravated assault, a fourth-degree felony, and a sentencing in another case.

Taylor had pled guilty to a charge of domestic violence, a fifth-degree felony during a recent pretrial and scheduled to be sentenced.

Court records indicated that on Aug. 25 Taylor assaulted his wife with a miniature baseball bat causing injury. He was originally charged with domestic violence, a fourth-degree felony, with previous such convictions noted. He had also been charged with having a weapon under disability, a third-degree felony, when he had a 12-guage shotgun in his possession.

The bonding company has until April 20 to bring Taylor before the court.

• Michael Scott Corner II, 19, 108 Canal St., Port Jefferson, was sentenced to five years of community control on a charge of criminal damaging, a second-degree misdemeanor. He was also ordered to complete anger and rage counseling, obtain his GED, was fined $200, and assessed court costs.

He was found to have vandalized a house at 503 Buckeye St. in Sidney.

• Rickey Gallimore Jr., 50, 745 Broadway Ave., was placed on five years community control on a charge of attempting possession of drugs, a first-degree misdemeanor. He was ordered to complete drug and alcohol counseling, fined $200, and assessed court costs.

He was arrested Sept. 19 in possession of heroin.

• Amy Lochard, 40, 1001 Fourth Ave. Lot 4, received five years of community control on a charge of attempted aggravated possession of drugs, a first-degree misdemeanor. She was ordered to complete drug and alcohol counseling, fined $200 and assessed court costs.

She was arrested Sept. 4 with Methamphetamines.

• An arrest warrant was issued for Anthony Stephen McLain, 29, 1107 Spruce Ave., who failed to appear for his sentencing on March 1. He was to be sentenced on a charge of attempted breaking and entering, a first-degree misdemeanor. He faces a maximum sentence of 180 days in jail and a $1,000 fine.

According to court records, on June 9 McLain broke into a house at 9770 Pasco-Montra Road. He entered into a plea agreement that indicated he was to testify truthfully during cases against co-defendants.

• Jenny Ryan, 47, at large, pleaded guilty to a charge of possession of drugs and possession of criminal tools, both fifth-degree felonies, during a recent final pretrial hearing. She faces a maximum of two years in prison and a $5,000 fine when sentenced.

• Kandice Lee Hall, 22. 3499 S. County Road 25A, was a no show for her final pretrial the Monday morning. An arrest warrant was issued, and Hall was brought into the court that afternoon. She was incarcerated on a $7,500 bond.

Hall is charged with endangering children, a third-degree felony. She is accused of placing her baby in a bassinet she knew was unsafe and failed to obtain proper medical treatment after the baby turned blue and stopped breathing.

• Jonathan M. Hoelscher, 25, 717 Taft St., entered a guilty plea to a charge of possession of drugs, a fifth-degree felony, through a plea agreement during his final pretrial. He faces a maximum of one year in prison and a $2,500 fine when sentenced.

• Daniel K. Boyd, 33, South Charleston, Ohio, failed to appear for a pretrial hearing. The court ordered the bonding company to bring him to court by April 20. He is charged with three counts of trafficking in drugs, all fifth-degree felonies.
