Swineford enters guilty plea to robbery, burglary

SIDNEY — The woman who attempted to rob two Sidney stores in April entered a guilty plea Monday in Shelby County Common Pleas Court.

Misty M. Swineford, 42, 3576 Wapakoneta Ave., Apt. 103, pleaded guilty to one count of burglary and one count of robbery, felonies of the third-degree.

Swineford was originally charged with one count of burglary, a felony of the third-degree, two counts of robbery, felonies of the third-degree, one count of failure to comply with order or signal of officer, a felony of the fourth degree, one count of possession of drugs, and one count of possessing criminal tools, both fifth-degree felonies, but the State of Ohio agreed to dismiss the remaining counts as part of the plea agreement.

According to court records the robbery counts were in connection to an incident on April 19, at the Family Dollar Store on Wapakoneta Avenue and then the Speedway store on St. Marys Avenue when she allegedly told the clerk she had a gun in her purse and demanded money. A short low speed pursuit also took place during this incident, and cocaine and a pipe were found on her person, resulting in the other charges. The burglary charge was from the same day when she allegedly trespassed in a residence on Redmond Road in Russia, and committed a theft offense.

Also as part of the agreement, the state will recommend concurrent sentences. Swineford is facing a maximum of three years in prison and $10,000 fine for each charge, but no prison term is mandatory. She is also facing a mandatory three years of community control.

Swineford is scheduled to appear for sentencing Aug. 2 at 2:30 p.m.
