SIDNEY — A conditional use permit for outdoor storage granted in April to Mantor Auto and Truck Repair by the Zoning Board of Appeals (ZBA) was revoked at the board’s meeting Monday.
Minor misdemeanor charges with penalties of $150 per day could also result for each day the business continues use of the property for storage of motor vehicles.
Brian Mantor, owner of Mantor Auto and Truck, requested the permit for outdoor storage in the business’s back yard to store dealership vehicles.
The revocation came after the city conducted a 60-day review for compliance of the outdoor storage at 825 W. Russell Road in the light industrial district.
Aside from typical required zoning conditions, the permit was granted in April under the following additional conditions:
• No storage of wrecked motor vehicles, vehicles with disabling damage, or motor vehicle parts are permitted;
• An application must be submitted for a site plan permit for the required paved surface;
• An application must be submitted for a fence permit for a fence at least six-feet-high;
• All established conditions must be completed within 30 days of approval. The ZBA will review compliance within no more than 60 days following approval of the conditional use permit.
Community Services Director Barbara Dulworth told the board Mantor failed to conform with the above conditions, nor has demonstrated intent to comply with them.
Dulworth also told the board upon revocation of the conditional use permit that if the business continues use of the property for storage of motor vehicles, it will be a violation of the zoning code and city will forward the case to the city prosecutor to file minor misdemeanor charges, per a section of the zoning code, with penalties of $150 per day for each day the violation occurs or continues.
Mantor was not present at Monday’s meeting.
Board member Jim Fortkamp asked if there had been any discussions with Mantor. Dulworth said she “has had absolutely no communication from Mr. Mantor.”
Upon receiving this information, the board unanimously voted to revoke the permit. Board member Richard Sommer was absent and was excused by the board.
