Grand jury hands up indictments

SIDNEY — The Shelby County grand jury issued indictments for rape, endangering children, witness intimidation, failure to appear, and drugs, among other charges, on Thursday, April 13.

David J. Hecker, aka David Myers, 48, at large, was indicted on two counts of rape, a first degree felony, and one count of gross sexual imposition, a third degree felony, for sexual contact with a female under the age of 13.

Trace O. Thomas, 19, of Sidney, was indicted on one count of endangering children, a second degree felony, for abusing his five month old daughter, causing serious physical harm.

Jacob O. Maynard, 19, of Sidney, was indicted on two counts of endangering children, a second degree felony, for shaking his infant son.

Keisonn Pate, Jr., 22, of Dayton, was indicted on two counts of trafficking in drugs and one count of possessing criminal tools, for marijuana and hashish, as well as bags and jars to store, transport and abuse the drugs. Additionally the grand jurors found Pate to be a major drug offender. Pate’s 2014 Honda Accord and $534 in cash are subject to forfeiture.

Bruce Upkins, 56, of Sidney, was indicted on one count of intimidation of a witness in a criminal case, a third degree felony, for attempting to influence, intimidate, or hinder a witness to not testify in a jury trial.

Lamone E. Upkins, aka Lemone E. Upkins, 54, of Sidney, was indicted on four counts of trafficking in drugs, fourth and fifth degree felonies, one count of aggravated trafficking in drugs, a third degree felony, and one count of intimidation of a witness in a criminal case, a third degree felony, for selling or attempting to sell cocaine, methamphetamine, and Buprenorphine (a schedule III controlled substance) in the vicinity of a school. Additionally he attempted to influence, intimidate, or hinder a witness into not testifying in a jury trial as a witness to his criminal acts.

Rachael R. Slife, 50, at large, was indicted on one count of failure to appear, a fourth degree felony, for failure to appear to a status conference after being released on her own recognizance in a case before the Shelby County Common Pleas Court, a fourth degree felony.

Michael A. Guthrie, 30, at large, was indicted on one count of failure to appear, a fourth degree felony, for failure to appear to a status conference after being released on his own recognizance in a case before the Shelby County Common Pleas Court, a fourth degree felony.

Emily M. King, 27, currently in the Shelby County Jail, was indicted on one count of illegal conveyance of prohibited item onto grounds of detention facility, a third degree felony, one count of aggravated possession of drugs, a fifth degree felony, and one count of possessing criminal tools, a fifth degree felony, for possessing methamphetamine, a schedule II controlled substance, and a clear vial to store it, and bringing it into the Shelby County Jail.

David L. Powers, 68, of Sidney, was indicted on one charge of aggravated possession of drugs and one count of possessing criminal tools, both fifth degree felonies, for possession of methamphetamine and a pipe used for storing, transporting, and abusing drugs.

Warren J. Powers, 33, of Sidney, was indicted on one count of aggravated possession of drugs, one count of possessing criminal tools, and one count of possession of drugs, all fifth degree felonies, for possession of methamphetamine, cocaine, and a pipe used for storing, transporting, and abusing drugs.

Christopher M. Elmore, 60, of Sidney, was indicted on one count of aggravated possession of drugs, and one count of possessing criminal tools, both fifth degree felonies, for methamphetamine, a schedule II controlled substance, and a baggie used to store it.

Melinda M. Miller, 49, of Sidney, was indicted on count of possession of drugs, and one count of possessing criminal tools, for Fentanyl, a schedule II controlled substance, and a paper ball used for storing it.

Lamar I. Caviness, 27, was indicted on one count of possession of drugs, a third degree felony, and one count of possessing criminal tools, a fifth degree felony, for marijuana and baggies to store it.
