Judge hands down sentences

SIDNEY – The Shelby County Common Pleas Court recently handed down several sentences for sexual battery, attempted aggravated assault, and receiving stolen property, among other charges.

David J. Hecker, aka David Myers, 48, currently in the Shelby County Jail, was sentenced to eight to 12 years in prison, with 167 days of jail credit granted, on one count of sexual battery. Additionally Hecker must serve a mandatory post-release control for five years. Hecker was indicted on two counts of rape and one count of gross sexual imposition with a person less than 13 years of age. Hecker must register as a tier III sex offender/child victim offender.

Joseph D. Lucas, 36, of Sidney, was sentenced to 11 months in prison and 180 days to run concurrently, with two days of jail credit granted, on one count of attempted aggravated assault, a fifth degree felony and one count of domestic violence, a first degree misdemeanor. Lucas was indicated on one count of strangulation, a third degree felony, and one count of domestic violence, a first degree misdemeanor, for choking an adult female household member, pushing her against the wall and punching her in the face.

Matthew R. Tucker, 42, currently in the Shelby County Jail, was sentenced to 11 months in prison, with 16 days of jail credit granted, after violation of the terms and conditions of his community control sanctions. Tucker was convicted on one count of attempted domestic violence, a fifth degree felony, for causing physical harm to an adult female victim after a previous conviction of domestic violence and domestic battery.

Cass Hensley III, 46, of Sidney, was sentenced to 90 days in the Shelby County Jail on work release, with 11 days of jail credit granted, for one count of domestic violence, a first degree misdemeanor. Hensley was indicted on one count of domestic violence, a fourth degree felony, for knowingly causing physical harm to a female victim with whom he was cohabitating after a previous conviction of domestic violence.

Brian C. Mader, 39, of Bradford, was sentenced to 11 months in prison, with 23 days of jail credit granted, on one count of receiving stolen property, a fifth degree felony. Mader was indicted on the same charge, for receiving and retaining a credit card which he had reasonable cause to believe had been stolen.

Mitchell R. Hudson, Jr., 41, currently in the Shelby County Jail, was sentenced to five years community control, with 85 days of jail credit granted, for one count of attempted receiving stolen property, a fifth degree felony. Additionally Hudson must successfully complete a mental health evaluation and counseling and must successfully complete the Thinking for a Change program. Hudson was indicted on one count of receiving stolen property, a fourth degree felony, for possession of a 2011 Chevrolet HHR he had reasonable cause to believe had been stolen. It was further specified that the Ohio State Highway Patrol is authorized to destroy or dispose of a Taurus revolver Hudson had on his person while committing the offense.

Tammy Napier, 46, currently in the Shelby County Jail, was sentenced to 36 months in prison, with 58 days of jail credit granted, concurrent, for each of two counts of aggravated trafficking in drugs, a third degree felony. Napier was indicted on three counts of aggravated trafficking in drugs, a second degree felony, for selling or offering to sell methamphetamine in the vicinity of a school. One count was dismissed.

April A. Hecht, 38, currently in the Shelby County Jail, was sentenced to five years community control, with 69 days of jail credit granted, for one count of aggravated possession of drugs, a fifth degree felony. Additionally, she must successfully complete treatment at a community based correctional facility. Hecht was indicted on one count of aggravated possession of drugs, a fifth degree felony, and one count possessing criminal tools, a fifth degree felony, for methamphetamine and a pipe. One count was dismissed.

Christopher M. Elmore, 60, of Sidney, was sentenced to continue his community control sanctions after violating the terms and conditions of his community control sanction. Additionally Elmore must successfully complete treatment at a community based correctional facility. Elmore was convicted on one count of aggravated possession of drugs, a fifth degree felony, for methamphetamine.

David L. Powers, 68, of Sidney, was sentenced to five years community control, with 35 days of jail credit granted, on one count of aggravated possession of drugs, a fifth degree felony. Additionally, Powers must complete treatment at a community based correctional facility. Powers was indicted on one count of aggravated possession of drugs, a fifth degree felony, and one count of possessing criminal tools, a fifth degree felony, for methamphetamine and a pipe. One count was dismissed.

Torrell L. Dorsett, 38, of Lexington, Kentucky, was sentenced to four to six years in prison, with 62 days of jail credit granted, on one count of trafficking in drugs, a second degree felony. Dorsett was indicted on one count of trafficking in drugs, a first degree felony, and one count of possessing criminal tools, for knowingly transporting fentanyl knowing it was intended for sale or resale in an amount between 20 and 50 grams, and plastic bags. One count was dismissed.
