SIDNEY – The jury pool was called for the case Bolcavage vs. Fair Haven Shelby County Home on January 22.

The jurors waited for over an hour in the courtroom while the lawyers for both plaintiff and defense met with the judge in the judge’s chambers. When Judge James Stevenson entered the court after his meeting, he thanked the jurors for their attendance and released them based on issues which were raised by the attorneys during the meeting.

Bolcavage vs. Fair Haven Shelby County Home is a medical negligence and wrongful death case regarding the death of James McGough. The plaintiff, Maribeth Bolcavage, is McGough’s daughter. Last year after four days of a jury trial, this case ended in a mistrial.

New video evidence was brought to light after the mistrial, and the plaintiff believes this video evidence is critical to their case. The counsel from both parties was able to view the video in the judge’s chambers. The defense counsel was granted a continuance so they can have their experts view the video.

Additionally, the plaintiff’s counsel requested the defense to reimburse travel expenses for an expert witness who was already on an airplane to Dayton. The defense counsel agreed to reimburse expenses up to $6,000.

The trial has been rescheduled for July 22-26.
