PIQUA — Shots were reportedly fired outside of Z’s Food and Spirits, located at 319 N. Wayne St. in Piqua, on Sunday, June 7, at 1:44 a.m. The manager stated that there were “two subjects shooting a gun into the air,” according to Piqua police reports.

Minster resident Derick M. Westfall, 26, was charged with first-degree misdemeanor aggravated menacing and fourth-degree felony complicity to improper handling of a firearm in a motor vehicle. Piqua resident Matthew Nash, 26, was charged with first-degree misdemeanor aggravated menacing and fourth-degree felony discharging a firearm on prohibited premises.

A witness stated that two men were driving by Z’s Food and Spirits when the passenger of the vehicle “held a shotgun out of the window and shot it into the air three times,” according to Piqua police reports. When Piqua police were dispatched, a vehicle matching the description of the one involved in the incident was found parked across from Lucky’s Bar.

The witness stated that Westfall was the driver, and Piqua police caught him running southbound on North Main Street toward Lucky’s Bar. Nash was believed to be the passenger and was “positively identified” as the shooter in the vehicle, according to Piqua police reports. A picture of Nash was also found on Facebook with him holding the same alleged gun that was recovered from the vehicle used in the incident.

Police seized a black Mossberg 500 12-gauge shotgun, marijuana, and two shotgun shells in connection with this incident.

Nash and Westfall were both incarcerated Sunday at the Miami County Jail. According to Miami County Jail records, they were released the same day.
