Young, others enter not-guilty plea

SIDNEY — A group of recently indicted people appeared in Shelby County Common Pleas Court Thursday morning for arraignment.

• Jakob JM Young, 21, at large, stood mute, so a not-guilty plea was entered on his behalf by the court on two counts of trafficking in drugs, felonies of the fourth-degree, one count of breaking and entering, a felony of the fifth-degree, and three counts of burglary, felonies of the third-degree. He was released on his own recognizance on these charges, but is still being held in the Shelby County Jail on a $50,000 bond from one count of aggravated robbery from when he allegedly robbed a man with a knife at an ATM machine at the US Bank at 1222 Wapakoneta Ave.

• Donald Hicks Jr., 36, of Dayton, entered a not-guilty plea on two counts of burglary, felonies of the second-degree, one count of possessing criminal tools, a felony of the fifth-degree, six counts of receiving stolen property, felonies of the fourth-degree, and one count of having weapons while under disability, a felony of the third-degree. A $50,000 bond was set and a no contact order with the victim was ordered. The 10-count indictment accuses Hicks of various firearm offenses, entering two different homes in Fort Loramie, and receiving various types of stolen property.

• Jessie Lee Smith, 21, at large, entered a not-guilty pleas on two counts of gross sexual imposition, felonies of the third-degree. According to court records, the first count reads: “During the time period of April 3, 2008 through April 17, 2008, … he had sexual contact with an 8-year-old male.” The second count reads: “During the time period of March 1, 2016 through March 4, 2016, … he had sexual contact with a 6-year-old female.” A $20,000 bond was set and a no contact order with the victims was ordered. It was also noted in court that he is already a sexual offender.

• Misty M. Swineford, 42, of Sidney, entered a not-guilty plea on on one count of burglary, a felony of the third-degree, two counts of robbery, felonies of the third-degree, one count of failure to comply with order or signal of officer, a felony of the fourth degree, one count of possession of drugs, and one count of possessing criminal tools, both fifth-degree felonies. A $20,000 bond was set and a no contact order with the victims.

According to court records the robbery counts were in connection to an incident on April 19, at the Family Dollar Store on Wapakoneta Avenue and then the Speedway store on St. Marys Avenue when she allegedly told the clerk she had a gun in her purse and demanded money. A short low speed pursuit also took place during this incident, and cocaine and a pipe were found on her person, resulting in the other charges. The burglary charge was from the same day when she allegedly trespassed in a residence on Redmond Road in Russia, and committed a theft offense.

• Jeffery L. Ward, 21, of Sidney, stood mute, so a not-guilty plea was entered on his behalf by the court on one count of disseminating matter harmful to juveniles, a felony of the fifth-degree. His $2,500 from municipal court was continued and a no contact order with the victim was ordered. According to the indictment, “On or about April 9, 2016, … he sent, delivered, furnished, disseminated or provided by way of electronic communication a nude and obscene photo to a 13-year-old juvenile.”

No further dates in these cases have been scheduled at this time.
