Millbourn enters not guilty plea, bond set at $10,000

SIDNEY — The Sidney man charged for his part in an overdose death in January appeared in Shelby County Common Pleas Court Wednesday without being summoned.

Samuel Millbourn, 21, of Sidney, found out Wednesday morning he had been indicted last Thursday before law enforcement had a chance to serve the indictment warrant, his attorney Robert Huffman Jr. said in court Wednesday afternoon.

During the group arraignment he entered a not guilty plea to one count of involuntary manslaughter, a first-degree felony, one count of possession of drugs, and one count of possessing criminal tools, both fifth-degree felonies.

For the involuntary manslaughter charge he is accused of selling heroin to a man which later caused the man’s overdose death. The latter two charges are from an incident on or about March 29, where he is accused of possessing “Fentanyl, a Schedule II controlled substance” and “capsules, a baggie, and a syringe used for abusing Fentanyl.”

Huffman said he had already been representing Millbourn on the two drug charges, which he had been indicted on in April, but they were consolidated into the involuntary manslaughter case.

On a joint recommendation from the prosecution and defense attorneys, a $10,000 cash, surety, or 10 percent bond was requested in this case. Judge James Stevenson accepted and ordered a no-contact order with the victim’s family in the case.

A waiver for a speedy trial was also signed by Millbourn, allowing the case to take as long as needed, and all continuances be granted in the course of the case.
