Sidney man sentenced to prison for sexual battery

SIDNEY — The Shelby County Common Pleas Court recently handed down several sentences for sexual crimes, operating a motor vehicle while under the influence of alcohol or drugs, violating community control, and drugs, among other charges.

Michael E. Sullenberger, 74, of Sidney, was sentenced to between five and seven and a half years in prison with mandatory five years post release control, with six days of jail credit given, for one count of sexual battery, a second degree felony, making him a Tier III sex offender. Sullenberger was indicted for one count of rape, a first degree felony, and one count of sexual battery, a second degree felony. One charge was dismissed.

Steven A. Herring, 32, of Botkins, was ordered to continue community control sanctions and additionally must continue counseling, after violating terms of his community control sanction. Herring was sentenced to five years of community control for two counts of unlawful sexual conduct with a minor, a fourth degree felony, making him a Tier II sex offender. Herring was indicted on the same two charges.

Cody James Spencer, 29, of West Milton, was sentenced to five years of community control, for one count of operating a motor vehicle while under the influence of alcohol or drugs (fourth in ten years), with two days of jail credit given. Additionally, Spencer must pay a fine of $1350, must successfully complete drug and alcohol counseling, must serve 90 days in the Shelby County Jail, must obtain DUI license plates and must obtain an interlock device. Spencer’s driver’s license is also suspended for five years. Spencer was indicted on the same charge and one count of driving under suspension, a first degree misdemeanor. One charge was dismissed.

Brent A. Wille, 47, of Ludlow Falls, was sentenced to five years of community control for one count of theft, a fifth degree felony. Wille must also serve 30 days in the county jail (work release is permitted if he is employed) and must pay restitution to the Estate of Terry Wille in the amount of $27,200. Wille was indicted on one count of theft, a third degree felony, for making unauthorized withdrawals from the estate checking account.

Deven Mikel Cowan, 34, of Sidney, has been sentenced to continue community control sanctions and to successfully complete the Thinking for a Change Program, for one count of forgery, after violating terms of community control. Cowan was indicted on one count of theft and one count of forgery, for stealing a check and forging the signature in order to cash it, fifth degree felonies. One charge was dismissed.

Shelly Lynn Roach, of Sidney, was sentenced to continue community control and additionally must successfully complete drug and alcohol counseling, after violating terms of her community control sanctions for three charges of trafficking in drugs, a fourth degree felony.

Brooks M. Smith, 27, of Piqua, was sentenced to three prison terms of 11 months, concurrent, for three counts of vandalism, a fifth degree felony, after violating terms of community control, with 14 days of jail credit given. Smith was indicted on seven counts of vandalism and one count of criminal damaging or endangering. Five counts were dismissed.

Chad C. Wilson, 48, of Sidney, was sentenced to five years of community control for one count of attempted domestic violence, a fifth degree felony. Additionally, Wilson must pay a fine of $200, successfully complete anger and rage counseling, successfully complete drug and alcohol counseling, and serve 30 days of work release, with three days of jail credit given. Wilson was indicted on one count of domestic violence, a third degree felony.

Edward J. Maurer, 47, of Minster, was sentenced to five years of community control and must pay $200 for each of two counts of attempted filing incomplete, false, and fraudulent returns, a first degree misdemeanor. Maurer was indicted on four counts of filing incomplete, false, and fraudulent returns, for failing to file his 2018, 2019, 2020, and 2021 tax returns, a fifth degree felony. Two charges were dismissed.

Amber P. Yeager, 36, of Sidney, was sentenced to five years of community control for one count of theft, a fifth degree felony, with four days of jail credit given. Additionally, Yeager must successfully complete treatment at a community based correctional facility, after completion must obtain employment and make payments in restitution of $1252 to Lowe’s in Sidney. Yeager was indicted on the same charge.

Norbert J. Stambaugh, 61, currently in the Shelby County Jail, was sentenced to 11 months in prison, with 144 days of jail credit given, for aggravated possession of drugs, a fifth degree felony, after violating terms of community control. Stambaugh was indicted for one count of aggravated possession of drugs and one count of possessing criminal tools, both fifth degree felonies, with one count dismissed.

Keondre L. Stephens, 22, of Sidney, was sentenced to five years of community control, and must successfully complete treatment at a community based correctional facility, for one count of possession of drugs and one count of possessing criminal tools, with no days of jail credit given, after an unsuccessful intervention in lieu of conviction. Stephens was indicted for possession of cocaine and a baggie used for storing, transporting, and abusing cocaine, fifth degree felonies.

Richard A. Martin, Jr., 35, of Sidney, was sentenced to five years of community control for two counts of aggravated trafficking in drugs, a fourth degree felony. Additionally, Martin must pay a fine of $200, successfully complete drug and alcohol counseling, and successfully complete the Thinking for a Change program, with 24 days of jail credit given. Martin was indicted on four counts of aggravated trafficking in drugs, a fourth degree felony, for selling or offering to sell methamphetamine. Two charges were dismissed.

Bruce Upkins, 56, of Sidney, was sentenced to five years of community control, consecutive, to each of two counts of possession of drugs, a fifth degree felony. Additionally, he must pay a fine of $100 for each count, successfully complete drug and alcohol counseling, and successfully complete the Thinking for a Change Program, with three days of jail credit given. Upkins was indicted on three counts of aggravated trafficking in drugs, a fourth degree felony, for methamphetamine. One charge was dismissed.

Emily M. King, 26, of Pueblo, Colorado, was sentenced to five years of community control for one count of aggravated possession of drugs, a fifth degree felony, with no days of jail credit given. Additionally King must successfully complete treatment at a community based correctional facility and successfully complete the Thinking for a Change program. King was indicted on one count of aggravated possession of drugs, a fifth degree felony, and one count of possessing criminal tools, a fifth degree felony, for methamphetamine. One charge was dismissed.

Brett A. Copeland, 31, of Mansfield, was sentenced to 17 months of prison, for one count of aggravated trafficking in drugs, a fourth degree felony, with no days of jail credit given. Copeland was indicted on two counts of aggravated trafficking in drugs, a fourth degree felony, for methamphetamine. One charge was dismissed.
